This Privacy Notice applies to the personal information Kate Roddy Physiotherapy Inc. (“KRPI”, “we”, “our”), owner of the Kegel Release Curve (“KR Curve”), collect when you use the KR Curve website at www.kegelreleasecurve.com or purchase a KR Curve.

  1. Collection and Use of Personal Information

We collect and use personal information on the KR Curve website for the purposes identified below:

1.1 KR Curve Online Store

When you purchase a product from the KR Curve Online Store or otherwise create a customer account, we collect your name, email address, phone number, billing and shipping address, and payment card information. We use this information to process your transaction and deliver your order. See “Protecting Payment Data” in Section 3.2 below for how we store and protect your payment information when you make a purchase from the KR Curve Online Store.

1.2 Warranty Requests

You may submit a warranty request for product replacement on the KR Curve website in the event that your KR Curve product fails to work due to a defect in workmanship or materials. To process your request, we ask for personal information including your name, email address, phone number, residential address, the retail location where you purchased your product (if not through this website), the date of such purchase, proof of purchase (i.e., an image of the receipt of purchase), reason for the warranty request, and any additional information you wish to provide. We use this information to process your request for warranty coverage.

1.3 Contests and Promotions

When you enter a contest or participate in a promotion, we may collect your name, address, email address, phone number, and any additional information or content required for the contest or promotion, including to deliver a prize to you, or that you otherwise provide, including your social media handle, profile picture and public posts or comments you make about our contest on social media networks. We use this information to administer the contest or promotion. As part of a contest or promotion, we may also share or otherwise publish the content you submit.

1.4 Contact Us

When you contact us with a comment, question or complaint, you may be asked for information that identifies you such as your name, email address, country along with additional information we may need to help us promptly answer your question or respond to your request, comment or complaint. We may retain this information to assist you in the future and to improve our customer service. We also use personal information to establish and manage our relationship with you and provide quality service.

1.5 Analytics

This website collects personal data to power our site analytics including information about your browser, network and device; web pages you visited prior to coming to this website; and your IP address. This information may also include details about your use of this website, such as clicks, internal links, pages visited, scrolling, searches and timestamps. We share this information with Squarespace, our website analytics provider, to learn about site traffic and activity.

1.6 Cookies

This website uses cookies and similar technologies which collect, process, store and analyze information obtained from your browser that track, measure and analyze the behaviors and usage patterns of visitors to the KR Curve website. We use the word “cookie” in this policy to refer to all such cookies and other tools. A cookie is a tiny element of data that the KR Curve website can send to your browser and can then be stored on your computer or mobile device, so we can recognize your computer or mobile device when you return. There are two types of cookies this website uses. These functional and required cookies are always used, which allow Squarespace, our hosting platform, to securely service this website. Other analytics and performance cookies are used on this site only when you acknowledge our cookie banner.

2. Sharing of Personal Information

We do not sell or disclose your personal information to third parties without your consent, except as set forth below or as required or permitted by law.

2.1 Legal and Compliance

We and our service providers may disclose your personal information if we have a good faith belief that such disclosure is necessary in response to a search warrant or other legally valid inquiry or order, or to another organization for the purposes of investigating a breach of an agreement or contravention of law or detecting, suppressing or preventing fraud, or as otherwise may be required or permitted by applicable Canadian, U.S. or other applicable law or legal process. Your personal information may also be disclosed where necessary for the establishment, exercise or defence of legal claims and to investigate or prevent actual or suspected loss or harm to persons or property.

2.2 Sale of Business

Personal information may be provided to third parties in connection with a business transaction, including a prospective or completed merger, acquisition or stock sale (including transfers made as part of insolvency or bankruptcy proceedings) involving all or part of KRPI or the KR Curve brand, or as part of a corporate reorganization or other change in corporate control, including for the purpose of determining whether to proceed or continue with such transaction or business relationship.

By submitting your information to us and using the KR Curve website, you acknowledge and consent to this sharing of your personal information.

3. Safeguarding and Retention of Personal Information

3.1 Internal Policies

We have implemented administrative, technical and physical measures designed to safeguard personal information in our custody and control against theft, loss and unauthorized access, use, modification and disclosure. We restrict access to information on a need-to-know basis to employees and authorized service providers who require access to fulfill their job requirements.

We have information retention processes designed to ensure that we will retain your personal information only for as long as reasonably necessary for the purposes set out above, considering criteria such as applicable rules on statute of limitations, legal requirements and the duration of your use of our services.

3.2 Squarespace

Our website store is hosted on Squarespace.  They provide us with the online e-commerce platform that allows us to sell our products and services to you.  Squarespace stores the data in multiple Tier III data centers across the United States.  They serve images and other static assets via multiple geographically distributed content delivery networks (CDNs).  This system ensures the data in each page view is served from the data center closest to the visitor’s location.  All Squarespace sites are hosted across their private cloud with full redundancy.  If a primary service fails, they are able to switch to a backup service.  Their Operations team monitors Squarespace sites 24x7 and is ready to respond to incidents within minutes of detecting an anomaly.

3.3 Protecting Payment Information

All payment data is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). PCI-DSS compliance is a security standard for companies and organizations that handle payment information from consumers. Both of Squarespace’s payment processors, Stripe and PayPal, are PCI compliant. The KRPI uses Stripe as our payment processor. All of Squarespace's built-in Commerce tools are compliant. Sensitive card data is never handled by Squarespace. It goes directly to the payment processor’s servers; Squarespace doesn’t have access to this information. Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction.  After that is complete, your purchase transaction information is deleted.  All direct payment gateways adhere to standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover.

4. Your Rights

Subject to applicable law, you may have certain rights with respect to our processing of your personal information. You may have the right to request access to the information we hold about you, obtain confirmation as to whether or not information concerning you exists, be informed of the content and source of such information and check its accuracy. You may also have the right to correct, update, delete, block, cancel, copy and transfer (i.e., the right of ‘portability’), or object to the use of, your information held by us.

If you consider that our processing of your personal information infringes applicable law, you may lodge a complaint with a competent supervisory or regulatory authority, which may be the authority in your jurisdiction of residence or work.
